Crime of child abduction and detention (Article 234 of Turkish Penal Code)

In this study, the crimes of child abduction and detention of children, which were regulated in article 234 of Turkish Penal Code, are examined. The crimes of child abduction and detention are important to ensure the protection of the family and custody rights of the children. In the first part of the study, the concepts that will facilitate the investigation of crime are explained. In this direction, the concepts of family, child, custody and guardianship are adressed. The following section discusses The Hague Convention on the Civil Aspects of International Child Abduction. In the second part, the kidnapping and detention by certain people that were arranged in the first two paragraphs of article 234 are examined. In the third part, the crime of keeping the child, who left the house, that is arranged in the last paragraph of the article ise systematically examined and their differences from similar crimes are revealed.
