The right to education and training of juvenile detainees and convicts

The concept of education is a reality that has continued to exist since the day man appeared on the stage of existence. Education also includes the concept of learning due to its nature. The right to education and learning have been protected under both Turkish Law and many international documents. The right to education and the right to education are addressed together in the text of the 1982 Constitution. The principles that this right is compulsory and free of charge for everyone without any discrimination are also very important. When it comes to education, children's right to education is the first thing that comes to mind. It is of great importance that juvenile convicts and detainees who are somehow dragged into crime/confronted with crime, who have to spend a certain period of time in juvenile closed penal institutions and juvenile education centers with certain limitations, do not fall behind in their education. As a matter of fact, the purpose of juvenile closed penal institutions and juvenile education centers is not to punish the child, on the contrary, it is to ensure that the child is reintegrated into society through education and improvement policies. For this reason, the criterion of compliance with the best interests of the child, which is within the scope of our research subject, is an important criterion that must be followed on the basis of the right to education. In thesis work, firstly, the international and national legal dimension of the child's right to education and learning will be discussed together with the historical process from the French Revolution of 1789 to the present day, then the best interests of the child and the best interests of the child in the juvenile criminal justice system, the concept of children dragged to crime, the right to education and learning of juvenile detainees and convicts in international and national law will be examined within the scope of international principles/rules, legal regulations, studies and statistical data.
