The role of the legislature in the Turkey's Presidential system

Abstract (EN)
Since the 1924 Constitution was adopted a trend towards strengthing of the executive branch to reducing the dominance of the legislature over the executive branch in Turkey. With the constitutional amendments made in 1971-73, the executive body continued to be strengthened in order to eliminate the defects in the parliamentary government system adopted by the 1961 Constitution. With the 1982 Constitution, the tendency to strengthen the executive body continued through the Presidency. By 2007, with the amendment made in the 1982 Constitution, it was decided that the President would be elected by the people. The President is elected directly by the people for the first time in 2014. Aftermath, the popular election of both the President of the Republic, members of the parliament and indirectly the Council of Ministers has raised the problem of double legitimacy. Since 2014 in Turkey, despite the adoption of a parliamentary system of government in the Constitution de facto semi-presidential system of government system it has been observed approaching. Indeed, dated 01.21.2017 and numbered 6771 Constitution of the Republic of Turkey in the adoption by referendum of the Law Amending the result was terminated dual legitimacy between the executive and legislative branches of state. Parliamentary system of government to replace the presidential system with the literature and with similar direction, "the presidential system of government" that the strengthening of the so-called presidential authority to Turkey was replaced by a specific system of government. In the study, it is tried to explain the relations between the legislative and executive branches in the new government system and the changing structure of the legislature in the new government system. In addition, the transformation of the legislative body since the 1921 Constitution and the development of its relations with the executive body has been included and its current position has been examined. The changes brought along with the new government system and the positive and negative opinions about the system in the doctrine were mentioned.
