Assassination of and physical attack towards the president of the republic

The crimes against the state maintain some values and interests of the state. According to Turkish Penal Code Chapter Four, Part 5, these values and interests are protected with the regulation of punishments against the "Constitutional Order and its Functioning" crimes. Our topic, which is the crime of the assassination of the president and any kind of assault against him/her, is explained in this part. The crime maintains values of the society presented by President and the life of the President and other kinds of legal values, which represent the unity of the country and the nation. Because of the importance of the legal value, which is maintained by the crime, there are some special situations in the legal definition of the crime. Firstly, according to the general provisions, even if the assassination of the president remains as an attempt, the punishment is not mitigated, instead of this, this crime is considered as a completed one and the punishment is given under this condition. Moreover, the punishment of any kind of assault against the president is aggravated by referring the crime in the code. In the first of the three sections constituting this work, the terms relating to this crime, historical developments regarding the crime, the systematic placement of the crime, the name used for the crime, the corresponding provisions under comparative law, the necessity of the existence of this crime and concept of political crimes are discussed. In the second section, the crime has been studied in detail under the criminal review methodology. Finally, the special appearances of the crime and the stipulated sanction are discussed.
