Defendant administration: The theoretical framework of the legal structureconsisted of the judicial decisions

Within the scope of our research, we approach the criteria for the determination and the positioning of the defendant, who is one of the parties to the judicature, under administrative procedure. By classifying the decisions of The Council of State, in terms of; time, chamber, type of case and legislative amendments; we attempt to detect the problems which emerge in the status quo and to provide perspectives and solutions to the issues that are fundamentally induced by non-uniform practices.
