Abstract (EN)
The increase in technological developments and global interactions has led to a significant increase in insurance activities which also causes legal dispitues in the same field. Court proceedings have traditionally been used to resolve these disputes, however the growing population and increase in cases have made the litigation process time consuming and labourios. As a result, arbitration has emerged as an alternative dispute resolution method that parties can voluntarily choose. Arbitration involves an independent and impartial third party, known as the arbitral tribunal, who facilitates the resolution of conflicts. Insurance arbitration is particularly beneficial in resolving disputes within the insurance field. It is an effective way of handling certain private law disputes that don't conflict with public order and are based on the mutual agreement of the involved parties. Hereby thesis highlights the role of insurance arbitration in our law, its importance in terms of its preference in the resolution of insurance disputes and the position of the Insurance Arbitration Commission vis-à-vis the courts. The paper discusses the eligibility of the judicial process conducted by the Insurance Arbitration Commission, its decision-making mechanism, and the eligibility and enforcement of its decisions. It also compares insurance arbitration and litigation. At the end of the thesis, the legal dimension of the arbitration conducted by the Insurance Arbitration Commission, along with its reflections on practical life, are evaluated, and decisions regarding compensation for disability and deprivation of support arising from disputes in compulsory third-party liability insurance (traffic) are examined and assessed.
