Abstract (EN)
The regular provision of public services is crucial for the peace and harmony of society. The most important element in effective execution of public services is public officials. This study examines the regulations concerning temporary assignments within the scope of administrative law, which are made to enable civil servants to perform public services more effectively and result in a change of workplace. Subsequently, the legal consequences of the temporary assignment of civil servants are addressed. Temporary assignment is the possibility of transferring public personnel between institutions and within institutions. Therefore, in the first section of our study, we address what a public official is, the criteria for public service, and the classifications related to public officials. The reason for conducting these examinations regarding public officials is that the regulations applicable to thereof vary depending on the type of employment they are in. In this respect, determining the conditions and legality of temporary assignments is crucial. Subsequently, the basic principles and concepts related to the concept of temporary assignment were examined. The temporary assignment procedure, which causes significant changes in the working conditions of public officials, is implemented within administrative law through multiple general and specific regulations. In the second section of our study, various legal regulations concerning the temporary assignment procedure applied to civil servants are examined, and detailed assessments are made regarding the procedure and principles of temporary assignment. Subsequently, in the third section of our study, the legal consequences of temporary assignment procedures for civil servants are evaluated. The rights and obligations of civil servants in temporary assignment procedures are examined. The distinctive features of temporary assignment procedures, namely the administrative discretionary power, per diem allowances and the institution of stay of execution, are addressed.
