Digital inheritance

As all transactions have moved to online platforms as a result of technological developments, digital assets such as personal messages, photos, videos and voice recordings are now being stored digitally instead of physically. Although people are able to dispose digital assets that they own while they are alive, they lose control of these assets after death. Here, the question of what will happen to said digital assets and whether the heirs will be able to access them arises. In order for the heirs to access the digital assets of the testator, the principle of universal succession, personality rights of the testators and their communication partners, secrecy of telecommunications, data protection rules and the contract between service providers and users which regulates the fate of the digital assets must be examined. In our study, whether the digital assets of the testator will be passed to the heirs will be analyzed.
