A unit of value measurement, a reference point, is needed in every trading environment. For centuries, both metals and printed papers, which we call money, have been used to measure value. At this point, with the rapid development of technology and the significant use of technological developments in the field of finance, "money" has become electronic and digital. Every innovation adds new concepts to the legal world. Because the legal order does not have the ability to interpret a phenomenon and situation without conceptualizing it, determine its legal nature and make a judgment. It is necessary to first use the correct concepts and then make consistent legal qualifications and evaluations based on these concepts. It is seen that the concepts of digital money and electronic money are often used incorrectly in teaching, but there are relatively more appropriate uses in recent works. For this reason, the thesis aims to contribute to the development of a correct and uniform use in doctrine by examining the concepts of "digital money" and "electronic money". In the first part of the study, the concept of digital money is explained in general terms and various application examples from the world and Turkey are mentioned. In the second part, the concept of electronic money is explained in general terms and various examples from Turkey are shown. In the third section, payment instruments including electronic money and digital money were examined in terms of their legal characteristics and the legal comparison of digital money and electronic money was discussed. In the fourth chapter, Electronic Money Institutions, another subject of our thesis, are examined in terms of Turkish Law.
