Abstract (EN)
Punishment is the material and moral sanction imposed on a person in case of prohibited behavior and actions. The general purpose of punishment is to prevent the spread of crime and to ensure the safety of society. The Ottoman Empire also created a unique penal system in order to ensure security in the society and protect the legal structure. Penalties prescribed for various crimes in the Ottoman period were reflected in Divan poetry. The poets mentioned the punishment and punishment methods applied in their period in their poems by associating them with various elements of imagination and analogy.In this thesis, it was investigated how punishment and punishment methods took place in Divan poetry, based on twenty-four divans selected between the 14th and 19th centuries. In this study, which is titled "Penalty and Punishment Methods in Divan Poetry", the place, use and characteristics of punishment methods have been determined based on sample couplets. The study is text-centered and has been carried out on the basis of sample couplets selected from the divans. In order to determine the penalty and punishment methods mentioned in Divan poetry, first of all, Islamic and Ottoman criminal law were mentioned. Here, information is given about the methods of punishment given to various crimes in the Islamic and Ottoman legal systems. In the section of "Penalty and Punishment Methods in Divan Poetry", which is the main subject of the thesis, the relationship of penalty and punishment methods with lover, amarous and various nature elements has been tried to be examined.
