Abstract (EN)

Kitab al-Newâzil of Abu al-Layth al-Samarqandî, one of the leading jurists of the fourth century hijri, is the first example of the works classified as "al-waqiat" that contains the third and last legal proposition after the works of Shaybani which were classified in a binary way as Zahir al-riwayah-Nadir al-riwayah and which also form the basis of the first two of the intra-sectarian law prepositions in the Hanafi sect. In this study, the last half of Kitab al-Nawazil, which hasn't been printed before and still is a manuscript and pioneered the birth of a new literature in the Hanafi sect; critically published according to the method known as the genealogical/stemmatic method in the field of text criticism, different from the classical tahqeeq methods. The method in question, in which all of the real and virtual copies obtained or revealed with the original (non-secondary) qualifications are used in the tahqeeq process observed to be utmostly successful compared to classical methods in revealing the closest version of the author's pen/language. The application of the genealogy method on classical works in the Basic Islamic Sciences literature constitutes a strong alternative to produce more reliable texts.
