The views of Abū Yūsuf on criminal law (In the context of Merğînânî's al-Hidāya)

In this study, the views of Abū Yūsuf on Islamic criminal law, as found in the sections on ḥudūd and qiṣāṣ in Marghīnānī's work al-Hidāyah, have been compiled. The identified views have also been cross-referenced with other Ḥanafī sources and presented along with their evidences. Furthermore, opposing views within the Ḥanafī school have also been included, supported by their respective evidences. This study consists of an introduction and two chapters. The introduction includes the significance, purpose, scope, and methodology of the topic, as well as information about Marghīnānī's life, his work al-Hidāyah, and Abū Yūsuf, whose views have been compiled in this study. In the first chapter, the views attributed to Abū Yūsuf regarding ḥudūd and ta'zīr are categorized under specific headings and presented. Additionally, the evidences supporting these views, as well as any differing opinions within the school, have also been provided along with their evidences. In the second chapter, the views of Abū Yūsuf on the sections concerning qiṣāṣ and diyah have been compiled. These views are presented along with the evidences that can be identified from other Ḥanafī sources, as well as the differing opinions. Finally, in the conclusion, a brief evaluation of the study is provided, and the outcomes and insights gained are shared.
