Abstract (EN)

The Turkish Civil Code adopts the regime of participation in acquired property as the legal regime. The regime of participation in acquired property based on the principle of division of property equally between the spouses. This matrimonial regime provides for a distinction of property: private property and the acquired property. The regime of participation in acquired property is dissolved by the death of a spouse or the adoption of another matrimonial regime. If there is divorce or nullity of marriage, the regime is dissolved and the dissolution retroactive to the date of the request. The dissolution of the matrimonial regime leads to the liquidation of the matrimonial regime. Liquidation may be under a termination agreement if the spouses have entered into, or through mediation, or judgment. The first stage of the liquidation is the profit calculation. Acquits of each spouse and added rewarded, after all debts are deducted encumbering them to bring out the benefit. After running the compensation provided by law, the husband creditor and the debtor spouse are designated. The amount that remains after compensation under the law of the value found at the end of this calculation shows "the claim of participation" for each spouse.
