Abstract (EN)

Electronic marketplaces are business models, which brought out by elektronic commerce and especially internet applications bringing buyers and sellers together electronically that allow them to do business with each other. Electronic marketplaces offering buyers the opportunity to buy a wide range of products and services without geographical limitation and time limit at a more affordable price, allow sellers to sell out of their property. During the realization of the commercial transaction, electronic marketplaces applications functions such as product information about the company, logistic support, order conformation, electronic payment, collection transaction, ensuring the reliability of the commercial transaction, supervision of mutual actions. Electronic marketplaces aiming to bring buyers and sellers together at low cost are preferred as day passes and their functionality increases. In this study, the legal relations between the parties in electronic marketplace applications and especially, the legal relationship called as electronic marketplace agreement between electronic marketplace management and service providers are discussed. In our study; basic information about the electronic marketplace are given, the parties of the electronic marketplace applications, comparison and qualification of contracts establisment between the parties with similar contracts, common features of the electronic marketplace contract, establishment of contract, debts of parties, termination of the contract, nature of legal relations between the parties and provisions applicable to these contracts are tried to be explained.
