Abstract (EN)
Electronic commerce, which emerged with the development of information technologies, has brought forth new concepts and challenges in the field of law. The reasons, such as conducting transactions electronically, lack of physical interaction between parties, and uncertainty about the recipient, have created specific problems for electronic commerce. To prevent these problems and establish a safe and transparent environment for electronic commerce, legal regulations have been established. In our country, the Law No. 6563 on the Regulation of Electronic Commerce, which was based on the 2000/31/EG Electronic Commerce Directive of the European Union, entered into force. This law primarily regulates the service providers and intermediary service providers in electronic commerce. The study aims to determine the potential legal responsibilities that may arise if the service providers and intermediary service providers, who are the main actors in electronic commerce, fail to fulfill their obligations. The study is divided into three parts. In the first part, general issues related to electronic commerce and the concepts of service provider, intermediary service provider, and buyer, which are the parties of electronic commerce within the framework of the Law No. 6563 on the Regulation of Electronic Commerce, are discussed. In the second part, the legal obligations of service providers and intermediary service providers under electronic commerce legislation are examined. Finally, in the third chapter, the responsibilities of service providers and intermediary service providers in case of violation of their obligations are evaluated.
