Between ash'ari and Shafii procedure traditions Ibn Berhan

Abstract (EN)

The fiqh method, which was first compiled with Imam Shafii's er-Risâle, was divided into two methods called mutakallimun and fuqaha over time. Fuqaha method mainly Hanafis; mutakallimun took its place in the literature as a method accepted by Shafiis. In this study, the method of mutakallimun to Shafiis; It has been argued that the claim that the fuqaha method belongs to the Hanafis and that this method was used by scholars of different sects in later processes is open to discussion. Another important claim of the thesis is that there is a similar opposition between Hanafis and Shafi'is in the field of methodology writing, as well as between Ash'ari scholars, who are mostly Shafi'i, and jurist Shafi'i scholars. In the research, Bâkıllâni and Cüveynî, who are the theologian scholars; The views of Şîrâzî and Semânî, who are among the Shafi'i methodists, are discussed by comparing them with Ibn Berhan within the framework of certain examples. Juwaynî, who is one of the contemporary Shafi'i scholars, was the representative of Ash'aris and Shirazi was the representative of jurist Shafi'i methodists. Ibn Berhan was chosen because the two scholars in question took lessons from their students and lived in the time intervals where this distinction existed, and the subject was studied from his procedural perspective. In addition, in the study, it was concluded that Ibn Berhan was a theologian methodologist. The distinction between Ash'ari and Shafi'i method is more evident than in the works of Shafi'i methodists. It has been determined that Ibn Berhan did not agree with the Ash'ari methodists on some of the methodological issues that were in dispute between Imam Ash'ari and Imam Shafii and preferred the opinion of Shafi'i methodists and Imam Shafii.
