Abstract (EN)
In our thesis XVIII. Century Sheikh al-Islam Menteşzade Abdurrahim Efendi's "Fetâvâ-yı Abdurrahim"in part of the fatwa book containing the family law related to the marriage of fetuses were latinized and evaluated. The socio-cultural structure of the period from the movement of the fetters was evaluated in the context of family law. Our research consists of an introduction and two parts, the introductory method, the boundaries of the subject and the concept of life and fatwa of Abdurrahim Effendi are emphasized. In the first part, the general aspects of the marriage / marriage contract are examined. In the second part, the conclusions of the marriage contract are examined. The fetters are latinized and evaluated on the basis of doctrine and practice. In the legal applications of the period, it was observed that the Hanafi sect did not go out of the sect and that it was careful to adhere to the sect, and in the conclusion part, the subjects that draw attention to the marriage were tried to be analyzed.
