Restitution sanction in The Law on Intellectual and Artistic Works

The subject of our study is restitution sanction which is regulated in the article 70/III of the law on Intellectual and Artistic Works no 5846. Within the scope of our study the legal nature, clauses, conclusions of that restitution requested lawsuit are examined. In this context clauses, conclusions and theories scrutinized of the legal nature of notional negotiorum gestio are included. In our study, which examined the other civil lawsuits regulated in the law on Intellectual and Artistic Works too, it is aimed to better understand of the request of restitution in comparison with requests relating to other lawsuits. While making that comparison of the lawsuits' clauses and conclusions, current legal arrangements with discussions on doctrine and related supreme court decisions are also included. Especially on the purpose of clarify the implementation of the law, in our study we gave wide coverage to the supreme court decisions.
