Food Producer's liability

Mass production has become widespread by changing production methods due to the increase in the population of the society and the change in consumption habits. This change has made the procuder's liability, which deals with the consumers claiming the damages caused by the products from the producers, a more current issue. Since food products are widely and frequently used and foods can directly affect human health due to their nature, the liability of the food procuder is a subject that is suitable for examination. The subject of this thesis is the examination of the legal liability of the food producer (tort liability) in accordance with the provisions of the Product Safety and Technical Regulations Law No. 7223. While examining the liability of the food producer, the Notion of food, food safety, food production techniques and their effects on human health are discussed. Later, the development of the liability of the food producer was examined within the framework of the liability of the producer and the legal characteristic of the liability that was the subject of study was evaluated. The terms of the legal liability of the food producer were discussed especially within the framework of the notions of noncompliant and defective, and how noncompliant could occur in food was examined. After addressing the other terms of liability, the harm and causality conditions, the parties to the liability and the limitation of liability issues were examined.
