Provisional entry

Turkish Civil Code numbered 4721, provides the opportunity to give annotations in land registry in three situations. These are annotations of personal rights, annotations of limitations of disposition powers in land registry and annotations of provisional entries. In this study, provisional entries in Article 1011 of Turkish Civil Code are examined. According to the opinions in Turkish and Swiss law on the matter, provisional entry and the practice of this concept will be evaluated. Provisional entry is applicable in two situations according to Turkish Civil Code. These are the cases of securing a claim of an unregistered right in rem and the cases where the law permits the applicant to complete documents showing disposition powers. However besides these cases, other cases that look like provisional entry and other cases that are accepted as provisional entry in practice will be addressed.
