Abstract (EN)
In this thesis, the issues related to the foreign judicial sale of ships are examined in the light of the "Draft International Convention on Foreign Judicial Sales of Ships and Their Recognition" (Final Draft) prepared by the Comité Maritime International (CMI). The main aim of this thesis is to determine the importance and the effects of Final Draft both in terms of international maritime community and Turkish law. This thesis consists of three chapter. In the first chapter, we examined the existing international and European instruments which touch on aspects of the judicial sale of ships. In the second chapter, we focused on the judicial sale procedure in the context of Turkish law. In the third and last chapter, we examined the Final Draft and discussed the necessity and feasibility of this instrument.
