Abstract (EN)
In the scope of our study -which is based on the crime of resistance to prevent public duty (TPC p. 265)- historical improvement of the crime with respect to the intention of criminalization of the crime and legal interest with relation to that intention, Ottoman codes, basic concepts of Penal Code Nr. 765 and resistance crimes in it and the regulation in foreign legal systems are examined in the first chapter. In the following chapter, elements of the crime are explained with special highlight on the effects of the legality of the public duty on the embodiment of the crime. In the third chapter culpability, special appearances for crime, procedural rules, statute of limitations and sanction are discussed under the light of judicial decisions and arguments in doctrine.
