Evaluation of blood fights in southeastern Anatoliaregion from the perspective of Islamic law (Karacadağexample)

Blood feuds, a tradition of the pre-Islamic period, are as old as human history. While this practice is as old as human history, it is unfortunately still a phenomenon we encounter in today world. This phenomenon poses a grave threat to many people fundamental rights, the right to life. Blood feuds are particularly prevalent in many parts of Southeastern Anatolia, the region where we live. As a result, many people face material and emotional harm. In blood feuds in the region, not only the murderer's family but also the victim's family are at risk of life and property. Blood feuds are among the most significant problems facing societies. In the Southeastern Anatolia region, blood feuds have numerous economic, political, social, and cultural causes. According to Islamic law, the worldly punishment for intentional murder is retaliation, blood money, and disinheritance, while the afterlife punishment is eternal hell. However, Türkiye's legal system does not lend itself to the application of worldly sanctions. Therefore, as an alternative solution under Islamic law, payment of blood money through mediation can be considered. Furthermore, by utilizing the fundamental principles of Islamic law, it is necessary to reform educational, economic, political, legal, social, and cultural elements to eliminate the causes of blood feuds in this region and raise public awareness on this issue.
