Abstract (EN)

Article 8 of European Court of Human Rights mention a regulation as a "Everyone has right of being respected in terms of private and family life, inviolability of domicile, and communication" and as a parallel with Universal Declaration of Human Rights, it is envisaged that everyone need to be respected in terms of right of private and family life, inviolability of domicile and communication.Communication makes up basic part of private life.Developing his personality freely is based on living environment that can express his emotions and thinkings freely and without restraint.Hence, every democratic law state responsible for providing living space that can establish relations by feeling safe and secure. As a necessary of the protection of the Human Rights, "privacy breachs" makes up demo of the actions that intervention of communication freedom are arranged as a crime in Turkish law according to 132. article of 5237 Turkish Penal Code. In the related article, three different crimes are arranged seperately, these are; "the breach of the privacy of the communication", " the revealment of the contents of communications between persons", "the revealment of the contents of own communications publicy".
