Contemporary fatwas and areas of disagreement regarding hajj and umrah: Compilation and analysis

This research examines the problems and challenges encountered during the pilgrimage (Hajj) and minor pilgrimage (Umrah) performed during specific periods. Hajj and Umrah hold significant importance in Islam, and there are variations in opinions and practices related to these religious acts among different sects and schools of thought. Islamic jurisprudence aims to serve the interests of individuals and prevent harm. Often, conflicts arise when conflicting interests and different considerations converge. In such situations, making a decision through analogy (qiyas) may be necessary to prioritize one interest over another. This preference may involve favoring one interest over another when there is no clear textual guidance. Consequently, differences arise in legal rulings and within different schools of thought because there is no explicit text addressing such matters. This divergence results from the jurist's ability to either not recognize the importance of a particular interest preferred in a previous ruling or to select a different method when the preferred interest is not apparent. Thus, disagreements arise in legal judgments and jurisprudential rulings due to the absence of a definitive textual basis. This reflects the essence of jurisprudential debates and serves as a reminder of the importance of considering the points of contention between two matters.
