Abstract (EN)

The science of khilâfiyyât, which studies disputed views between scholars and their evidence, is a sub-branch of Islamic jurisprudence (fiqh). The formation of this science, around the second century of Hijra, was assisted by the establishment of the schools of law (madhabs). Many books also were started to be written in this field compiling the conflicts of the views. This thesis, which studies the science of Hilâfiyyât, consists of three chapters and, in addition; translation, and commentary of the hilâfiyyât book which is contained in Omar al-Nasafî's encyclopedic book of Matla' al-Nujûm is added in the appendix of the thesis. In the first chapter, the hilâfiyyât books were classified by a special method which was used only by the Hanafi scholars and after this classification the works of Hanafi scholars were examined. In the second chapter, Matla' al-Nujûm which written by Nasafî and the hilafiyat book is detailly described. And in the last chapter, the critical edition of the hilâfiyyât book is given. Lastly translation of the khilâfiyyât book and the arguments of the sides in the disputed matters are briefly explained.
