Transcription and evaluation of the Court Record book no. 294 of Havâss-ı Refî'a (Eyüp) Court

This thesis was prepared on the basis of the court record book no. 294 and dated Hijri 1212-1213 (C.E. 1797-1798) of Havâss-ı Refî'a court. The book was written in Ta'liq font; it consists of 44 leaves in total and contains 141 documents. All legal transactions such as appointment of guardians, trustees, and attorneys, portion of the inheritance, transferring the inheritance of the persons without heirs to the state treasury and selling it, borrowing and proof of debt collection, sales of movable and immovable properties, alimony, and marriage were recorded in the court record book forming the basis of the thesis. However, the vast majority of the court record book pertains to portion of the inheritance. Qadi record books that also involves this study contains all records of the courts that were written by the qadi and took place in the region during the office of the qadi and the documents such as orders, edicts, and commands sent from the central administration. Qadi record books contain information about place names and architectural structures in the region. For this reason, qadi record books which are also important for urban history research, contain a lot of information such as architectural structures that have not survived to the present day or by whom and in what year the architectural structures that have survived to the present day were built. Therefore, thanks to their richness, the qadi record books are among the important sources not only for the history of law, but also for the social, economic, cultural, political, and urban history of the Ottoman Empire. All legal disputes faced by the local community and the decisions of the qadi were written in the court record book no. 294 of Havâss-ı Refî'a court which is the subject of the thesis. The study evaluated the decisions in the court record book by presented their exact transcriptions and summaries.
