Obligation of the physician to treat the patient and to prescribe

With the definition of the World Health Organization (WHO), health means not only the absence of disease or infirmity; but also a state of complete physical, mental and social well-being. Health is the most precious treasure of man. For this reason, the health service provided under the supervision of the state at the point of protecting human health is very important. The active protagonists of health care are the patient and the physician. The relationship between the patient and the physician is not a haphazard relationship, it is a relationship based on legal assurance. In this relationship, the physician has legal responsibilities towards the patient. One of these responsibilities is the responsibility to treat and prescribe. The physician considers all the professional and legal consequences of the process in the treatment process, which starts with the patient's will in a sudden developing situation, or by applying his will. In order for the treatment to be successful, medication should be used to support the treatmentIn this process, it imposes many obligations on the physician, including prescribing and explaining the benefits and harms of the drugs he prescribes. The physician also has responsibilities for the prescriptions he writes. The most important of them are taking care, prescribing and prescribing medications in accordance with the treatment, avoiding various mistakes (malpractice), and most importantly, directing the treatment process in accordance with the patient's best interests. In this study, the obligations of the physician to treat and prescribe medication were examined by considering the health law. The aim of our study is to include the mistakes that doctors often make in the process of drug treatment and prescribing, and the legal responsibilities that doctors will face after the damage caused by these erroneous practices have also been discussed. Because mistakes made by the doctor in the process of drug treatment and prescribing, such as incorrect medication, incorrect dose, use of drugs outside the indication, pose a risk of further deterioration of the patient's health and loss of life. As a result of the study, it is clearly observed that it is very important for patient health for physicians to take care of the stages of rational prescribing process in the process of treating their patients. In addition, it is thought that it will be appropriate to provide support training to physicians about the rational prescribing process, to educate physicians and especially other medical personnel about this issue, to eliminate and improve the problems in this regard. In this thesis, the obligation of the physician to treat the patient and write a prescription within the framework of health law is discussed.
