Doctor's professional liability insurance

In Turkish Law, Doctor?s Professional Liability Insurance was regulated for the first time by Professional Liability Insurance General Conditions and by Doctor?s Professional Liability Insurance Clause. In order to define Doctor?s Professional Liability Insurance, it is necessary to determine what the insured risk is.The claims of third persons who suffer from doctor?s wrong diagnosis and treatments are insured by Doctor?s Professional Liability Insurance Contracts, In other words, Professional Liability insurance plan helps counter the risks that the doctors can face during their practice. However, Professional Liability Risks have been held subject to certain exclusions and it is restricted in terms of location, person and time in accordance with the Turkish Commercial Code and Professional Liability Insurance General Conditions.This thesis aims to determine which professional liability risks may be subject to insurance coverage and to analyse the obligations of the parties? to the insurance contract, within the frame of the recent regulation and the provisions of the Turkish Commercial Code.
