Abstract (EN)
It is aimed in this thesis to examine the duty of care that has its source in physicians' medical contracts. In the first chapter of this study, medical contracts and their legal characteristic features are examined in order to concretize the duty of care and to determine its scope. The duty of care of physicians which is aimed to be concretized in first chapter is examined in the latter. Thus, in the second chapter, considering the function of this obligation as its primer role in physicians' secondary obligations to be duly performed, physicians' obligations, other than their duty of care, is examined limited to this function. In the latest chapter, noncompliance with the duty of care is analyzed with the help of typical medical cases in practice.
