Abstract (EN)

Our study examines the time of performance in terms of the creditor and the debtor and at this point, the basic concepts such as Due date, Termin, Frist and Early Performance are explained in detail. Two things are understood from the concept of time of performance: when creditor has the power to demand the performance; the other is the time the debtor can fulfill the performance. In the first sense, the moment when the creditor may request the performance of the debt (Fälligkeit). In the second sense, the moment when the debtor has the authority to fulfill his debt indicates that the debt can be executed (Erfüllbarkeit). Although the creditor cannot demand performance before the due date, the debtor has the authority to perform before the due date, as a rule. When does the debt become due and in what cases does the debtor of the debt that is not due have early performance authority, in which cases does he/she not have ?, we will seek answers to these questions in our thesis.
