Abstract (EN)

The margin of appreciation doctrine was established by the case law of the European Court of Human Rights, which is the control mechanism for the international protection of human rights. With the margin of appreciation doctrine, the States parties were considered to be in a position to make a more accurate assessment of the courts within their sovereignty area, and thus a space was left to the parties by the court for interventions on fundamental rights and freedoms. While the Court assesses the margin of appreciation doctrine in the context of freedom of expression, it carefully examines whether the freedom of expression is required in democratic societies and the need for intervention in a democratic society. In this context, to understand the situation of freedom of expression in Turkey, example of how to interpret the margin of appreciation afforded to them by the court decisions of the national authorities is important in light of the disclosure.
