Legal liability of the medicine producer

Medicines have an important place in our lives and are usually the first way of treatment nowadays. The reason for this is that with the industrial revolution, mass production was started in the production of pharmaceuticals. Mass production in pharmaceuticals has also brought some problems. One of these problems is that a faultly produced medicine reaches many users. Launching the faultly medicine can also harm many people. For this reason, the medicine must provide the justified safety expected from it. If the faultly medicine has caused injury or death to the user or damage to his property, the medicine producer must compensate for this damage. Although there is no direct medicated law in our country, the concept of legal liability of the medicine producer has been generally evaluated within the scope of the producer's responsibility. While making this evaluation, the legal responsibility of the pharmaceutical producer is explained by referring to The Law No.7223 on Product Safety and Technical Regulations Law (ÜGTDK), which entered into force on 12.03.2021. In addition, Turkish Code of Obligations, Consumer Protection Law and related regulations and international sources are mentioned.
