Abstract (EN)
In this research international responsibility of the state has been examined in the context of investment arbitration. The rules regarding responsibility of the state does not only cover relationships between the states, but also relationships between private persons and the states. Therefore the rules in question are directly relevant to investment arbitration. In this regard, applicability of the rules on the law of state responsibility and the question of to what extent these rules must be applied have been assessed primarily. This assessment has required examination of complex subjects such as the nature of investment law and its relationship with general international law, the relationship between international investment treaties and customary law and the role of international law as law applicable to the substance of the disputes. After answering these theorotical questions, the matter of how the rules on state responsibility applied in investment law has been analyzed systematically in light of arbitral awards and finally relevant results have been provided.
