Abstract (EN)

This research is about the identification, analysis and classification of the hadiths that Imam Mâlik b. Anas did not narrate in his only extant work, Muwatta. In the research, classical and modern period hadith, fiqh, sharh, history, terâjim and etrâf sources were utilized. Hundreds of studies on the Muwatta from the classical period onwards have discussed Imam Mâlik's method of hadith and fiqh, but no consensus has emerged, especially on issues such as his intention in the expressions he used in his work and why he narrated hadiths contrary to his fatwa. Other works on the Muwatta have dealt with the differences between the narration copies of the Muwatta, which were spread to wide Islamic geographies through his students. However, since Imam Mâlik did not include all of the hadiths he narrated during his lifetime in his Muwatta, the question of why these hadiths were not included in the work has remained topical. These narrations, which are not included in the Muwatta, can be found in various works of our vast corpus of hadith. In the first (introductory) part of the research, the importance of the selected topic in the field of Islamic sciences, the methods, boundaries and literature of the research are mentioned. In the second chapter, Imam Mālik's scholarly life and personality, the scholarly conditions of his time, his teachers, his students, his hadīth and the characteristics of his Muwatta are mentioned. Since there have been extensive previous studies in this field, more emphasis has been placed here on the details that will open the door to the identification and evaluation of non-Muwatta hadiths, which will be analyzed in the last chapter. Thus, the relationship between Imam Malik's authority in the field of hadith and fiqh and his meticulous attitude in narrating hadith is revealed, and evaluations are made in order to understand his dispositions on the Muwatta more clearly. In the third chapter, firstly, extensive information on how and from which sources Imam Malik's hadiths that are not included in Muwatta were identified is given. Then, in addition to the studies on the methodology of fiqh and hadith that he applied in his work since the classical period, analyses were made by making use of current findings. Some of these analyses focused on determining why and by which method Imam Malik narrated the hadiths that contradicted his views in Muwatta. As a result of this determination, his intention in the hadiths that he did not include in his work was tried to be illuminated. Finally, the details of the method Imam Mâlik generally followed in the hadiths he did not include in his Muwatta have been determined, and the non-Muwatta hadiths have been classified and tabulated according to this determination. In addition, the appendices provide a list of non-Muwatta hadiths of Mâlik that were recorded throughout the research and grouped according to the classification made.
