Abstract (EN)

Planning is one the works conducted by certain ranks of the administration basing on the authority granted by laws. Proper and functional planning has been more significant as a result of population shift from rural to urban areas due to industrialization increasing by globalization. Such that formation of large cities and consequently arising dispersed urbanization requires revising shanty houses and their infrastructure and superstructure, building educational, regional, social and cultural reinforcements and conducting these services in a planned and systematized way. Many plan types, development plans being in the first place, are seen in the state organization. Zoning plans may be the most significant one among these plans. Zoning plans are plans which can satisfy the common needs of the relevant area and local community within a certain time period and new needs possible to arise till the target date and eliminate the negativities possible to be caused by former plans and directly affect the relevant area. The most significant aspect of zoning plan preparation is authority. In other words, there are many offices authorized to prepare zoning plans. Although some of them obtain this authority from the Zoning Law No. 3194, others are authorized to prepare or make third parties prepare their own zoning plans. Thus, it recalls conflict of authority to mind in the first place. However, although there is no conflict of interest between provincial municipalities and special provincial administrations, conflicts of authority possible to arise between metropolitan municipalities and district municipalities have been ruled out in favor of the metropolitan municipalities. On the other hand, possible conflicts of authority between different organizations and institutions will be resolved by the authority rule suggested by the special law. Implementing zoning plans is also a different procedure. Different tools can be used for this purpose. However, no matter which method is preferred, the public interest purpose suggested by law should not be ignored. Even though it is necessary to prepare plans in a way to satisfy the actual and future needs of the local community rationally within a certain period of time, an irrecoverable urbanization profile shall arise in case mistakes are made by deviating from the public interest in the implementation phase or the personnel assigned during preparation and implementation of the plans look out for themselves or 3rd parties. In order to avoid such an unhealthy housing which ignores the future, it is required to look after the public interest and act accordingly in not only preparation but also implementation phase of the plans. A modern and efficient urban life only can be formed by this approach.
