Administrative and judicial audit of zoning plans

Zoning Law, one of the sub-branches of administrative law, is developing faster than in the past, and in addition to this development, almost every person is now faced with the effects and consequences of zoning plans. In this regard, Zoning Law, which is an important field of law today, has also received its share from this development and has become more detailed and almost every aspect is regulated by laws and regulations. It is possible to say that after this rapid development in zoning law, the resulting law and other sub-legislation have become increasingly complex. In addition, the fact that the legal regulations regarding zoning plans are handled with a casuistic method has caused zoning law to become a situation in which citizens, especially the administrations making zoning plans, have difficulty in mastering. In this context, this thesis aims to inform the citizens who are subject to zoning plans about the existence and details of administrative and judicial control mechanisms against these administrative procedures, to explain the current implementation of these mechanisms and their results, to identify some problems related to Zoning Law and to offer solutions to these problems. was written. Our legislation includes regulations regarding the preparation and approval stages of zoning plans, which are the general regulatory administrative process of the administration, as well as regulations regarding the administrative and judicial supervision of these plans. In this study, the types and legal nature of zoning plans will first be explained, then the administrations with general authority in plan making will be specified, and then detailed examinations of the administrative and judicial review methods of zoning plans will be included. In addition, various problems and deficiencies that arise in the implementation of these mechanisms will be revealed and various suggestions will be made about them.
