Abstract (EN)
In our work, it is inspected that the place of readmission agreement in international asylum law and if these agreements constitute a contradiction to the rights of immigrants, asylum seekers and refugees. In this context, Readmission Agreement which is signed between European Union and Turkey creates the scope of this work. During this inspection, it is benefited from books, journals, articles, academic dissertations and online resources which are published in this discipline, on topics like creation of asylum law, rights of refugees in international law, development of readmission agreements and especially agreements which are signed by and between European Union and third countries. Some ECHR ruling cases are included. Furthermore, provisions of Turkey and European Union Readmission Agreement and provisions of other related agreements are included. In the first section of our work; migration, refugees and readmission agreements are inspected in general terms.The terms, refugee, immigrant and asylum seeker's legal status is explained in historical process by defining them. In the second section, Readmission Agreement which is signed between European Union and Turkey is inspected. And by including Agreement's provisions, topics like what the scope of acceptance is according to Agreement and how readmission will be applied to these people who are in the scope is inspected. In the third and final section, it is given place to criticism which is brought in the context of human rights to readmission agreements as a whole. In particular, European Union and Turkey Readmission Agreement is given place. It is inspected that if these agreements harm rights of immigrants, asylum seekers and refugees. And it is tried to propose some solutions to the problems that may occur during the application.
