Jurisdiction and responsibility of states within the context of extraterritorial application of human rights treaties

In this study, the extraterritorial application of human rights treaties will be examined. This research aims to analyze how and to what extent states benefit from the rules on the law of state responsibility and humanitarian law while determining the responsibility of the state acts and omissions outside its territory. A conceptual framework will be presented in the first part of the study within this scope. In that regard, the reader will be familiarized with the concept of jurisdiction in human rights law and the concept of jurisdiction in general international law. The second part will deal with the applications of human rights treaties outside the territory, focusing on the decisions, general comments, and concluding observations of human rights bodies in the context. In the third part of the study, the relationship between human rights treaties and the rules on the law of state responsibility and humanitarian law will be analyzed in the light of the practices of human rights bodies.
