دراسة الأحكام المتعلقة بالزواج في القانون العراقي من منظور الفقه الإسلامي

Iraq consists of different ethnicities, religions, and sects; therefore, it is natural to them to follow their own laws and customs which refers to their affairs, including what is related to the issue of marriage. It is difficult to set a single law for all these people, so that they can act accordingly. However, after different stages of change and alteration, the legislators of Iraqi law were able to develop the personal law. This law has endured since 1959 to the present time with minor changes to some of its articles. This is what aroused our interest to study the provisions of this law and to analyze its articles to learn about the legal nature of these articles, their relationship to Islamic jurisprudence and to know the sources of their derivation from the jurisprudential schools. After studying these articles, we found that the Iraqi legislators did not adhere to a specific school of thought from the well-known Islamic schools of thought, even they did not rely on the opinion of the majority, so one may finds in some of the articles that they stands with the opinion of majority, sometimes prefers the opinion of one of them, at other times adopts sayings that are from outside the Islamic schools of thought. We also found the usage of expressions that have many meanings and are open to different interpretations.We also noticed in the study that some of its articles needed to be reviewed in their formulations, as well as taking into account in the light of the situation which has been evolved in the modern technological means, change in the customs and traditions with regard to expenses, dowry, and the woman's relationship with her husband, and the emergence of some types of marriage that were not usual before, such as misyar marriage and the marriages with the intention of divorce and other different rulings. This thesis took the descriptive and analytical approach in studying the articles and tried to identify the sources of the Iraqi legislators and put forward some proposals to reformulate some articles and develop other articles that were not addressed by the Iraqi Personal Status Law.
