Iran's Cheque Law and comparing to Turkish Cheque Law

Abstract (EN)

At Iran's trade bazaar like Turkey and many other countries the Cheque papers has too important roles. There are three kinds of important commercial documents that in Iran those names are, Sefteh, Berat and Cheque. This thesis issue's is about Iran's Cheque Law and comparing with Turkey's Cheque law. We easily can say that in Iran the Cheque papers are more common than, in Turkey. Also we can say that in Iran most of the people use the Cheque papers instead of currency whenas in Turkey cheque papers usually are used by merchants and in Turkey special cheque papers designed by banks but in Iran ther is no any special cheque for merchants. Iranian banks gives cheque papers to most of their customers without any hard terms, and maybe we can say that, any person who can has a normal account, also can has a cheque account, and I think that this is the reason of too many econemical problems at Iran, and the number of bad cheuqe or overdrafts are increasing the day after day. 1. The banks have couple terms for opening cheque accounts that we repute them 2. The man who wants to has a cheque account must work and has salary Put a rate of money at the cheque account 3. A man who has a cheque account by himself, warranty the new man who wants to open a cheque account At Iran's commercial law, the fourth part is about cheque. The cheque and Berat and Sefteh are commercial documents. At Iran's commercial Law from 310 article to 318 is about cheque papers. As there at Iran's law the most of the rules are the Islamic rules, it is the reason of differenty of Iran's law but in the commercial law Irans rules are almostly same as the word because the Islamic rules is not about the trade and commercial.
