Privacy in Islamic Family Law and its legal results

Abstract (EN)

The term privacy has a very important place in Islamic family law. The term privacy started to shape ın the era of the prophet Muhammad (p.b.h) and become a subject that all the Jurisprudent pay attention. Privacy will protect its importance everytime and everywhere and ıt will cause to leagal verdicts. To understand the verdicts of the halvet one should know the essence, parts, and obstacles of the privacy. This humbel work is consist of three chapters. The term forbiddness which regulates the privacy as halal or haram is studied in the first chapter. Also additon to this the parts and causes of privacy is also studied in the same chapter. The essence of privacy, the jurisprudents understanding of halvet, the description of halvet as valid and unvalid, haram privacy and mübah privacy in terms of legal understanding and types of halvet is studied in the first chapter. In the second chapter after explaning what prevents privacy and what kind of outcomes it has in terms of Islamic family law and the opinions of Islamic sects on the matter is examined. The topics that can be effected by privacy is examined under different parts and jurisprudents ideas on the each topic is given. In the last chapter we discuss the readers outcome from this work and ended our work here.
