The distinction between ta'abbudī and ta'līlī rulings in the methodology of islamic law

When examining the methodology of Islamic jurisprudence (fiqh), it becomes evident that ta'abbudī and ta'līlī rulings constitute the fundamental pillars of Islamic law and play a foundational role in the determination of legal judgments. These rulings not only define the nature of fiqhī provisions but also serve as decisive elements in constructing the methodological framework of Islamic jurisprudence. This study explores the lexical, terminological, and technical meanings of ta'abbudī and ta'līlī rulings separately, highlighting their functional aspects within Islamic fiqh. These rulings are analyzed independently within the domains of uṣūl al-fiqh (principles of Islamic jurisprudence) and furū' al-fiqh (substantive Islamic law), with relevant examples provided to clarify their application. To establish a balance between the universality and flexibility of Islamic jurisprudence, it is crucial to precisely delineate the boundaries of ta'abbudī and ta'līlī rulings. One of the defining characteristics that distinguish Islamic law from other legal systems is its ability to uphold universal principles while simultaneously exhibiting adaptability to changing circumstances of time and place. The universality of fiqh relies on the existence of fundamental rulings applicable across all societies and historical periods, which are best represented by ta'abbudī norms. At the same time, the flexibility of Islamic jurisprudence is equally essential, as it enables the legal system to engage with an evolving world and to harmonize with diverse social and cultural contexts. This adaptability is best exemplified by ta'līlī rulings. The primary objective of this study is to contribute to a precise understanding of the balance between the universality and flexibility of Islamic jurisprudence. Failure to establish this balance may lead to various legal challenges and the emergence of divergent ideological trends. In this regard, the study also addresses different scholarly perspectives, underscoring the significance of accurately identifying ta'abbudī and ta'līlī rulings and maintaining a well-defined equilibrium between the universal principles of Islamic law and its capacity for adaptation.
