Abstract (EN)
The power of discernment, with a general definition, is the one who can provide the good for those who can take advantage of the bad. The subject of our thesis is the concept of power of discernment in terms of Islamic law. The concept of the power of discernment is one of the most important issues in Islamic law. Because the power of discernment is a concept that has psychological links such as reason, will, consciousness and mind. The power of discernment is a concept explained in the subject of competence in the field of fiqh and has an important place in terms of one's actions. The person's gaining the title of obliged and therefore having some rights and responsibilities depends on having acquired this ability. In some cases, it removes the power of discernment. These situations result in the granting of certain exemptions to the person. These exemptions may be congenital or may occur later. The main purpose of our study is to be able to deal with all aspects of the power of discernment, which is one of the important concepts of the capacity. However, not only the power of discernment but also some concepts related to it need to be explained. Because the power of discernment is often confused with the concepts associated with it. In presenting this study, the idea of filling the said deficiency is dominant.
