Wedding ceremonies and the legal status of jewelry in Islamic law: A comparative perspective with modern law

Although the wedding ceremony, which is a universal phenomenon, varies among nations and cultures, it is a concept with a legal dimension. In today's modern law, although there are rules on how the wedding should be held, there are also legal opinions on the provision of jewelry at the wedding. According to the latest Supreme Court decisions, the jewelry is deemed to belong to the groom or the bride, and has made a ruling on the sharing of jewelry in divorce. While the marriage contract in the presence of two witnesses is required in Islamic law, the wedding ceremony is left depending on the culture. Although a special ceremony is not required, it allowed a wedding ceremony to be held. Various wedding ceremonies were held both in the early periods of Islam and even during the Ottoman period, and these ceremonies were shaped according to the culture and customs of that period. The aims of this thesis are to investigate whether today's wedding ceremonies have a legal framework and whether the wedding ceremonies to be held within this legal framework are similar to Islamic law. In addition, comparing the ruling of jewelry in terms of Islamic law and modern law in the context of the latest decision of the Supreme Court reveals the other purpose and importance of this thesis.
