Abstract (EN)
In Islamic Law, kinship is formed through blood, marriage and breastfeeding. While Islamic Law grants rights and tolerances to people in some areas due to kinship; It has assigned responsibilities to people in some areas. For example, while allowing women tolerance in greeting and shaking hands with men who are close relatives, as well as in terms of clothing around them; Since the parents of the spouses have become biological parents for each other, it has placed a religious and moral responsibility on the spouses for their care.. It is established by the Holy Quran and Sunnah that sila-i rahim which expresses the continuity of relations between relatives is a religious and moral responsibility that everyone must fulfill.Sıla-i rahim means treating relatives spiritually; In its financial aspect, it is realized in the form of donating money to relatives. In Islamic Law, the right to hidane which refers to the care and upbringing of the child, the marriage custody of young girls and the right to alimony, passes to asabe and zevi'l-erham due to kinship after the procedure and offspring. The relatives who have the right to inherit are ashabü'l-ferâiz, asabe and zevi'l-erham. While Islamic Law does not accept the testimony of spouses and descendants in favor of each other because it may create suspicion; It accepts the testimony of other relatives in favor of each other. As can be seen, the institution of kinship brings with it moral and legal regulations. This study aims to revitalize kinship relations which have been losing their importance in recent years and to remind people of their moral and legal responsibilities in kinship relations.
