Fasid marriage and it's provisions in Islamic law

The concept of fesad, which is formed around the views of the Hanafi sect in Islamic family law, is discussed within the scope of marriages in this study. Contrary to false marriages, which have no results, vicious marriages have responsibilities on the parties. With this study, the conditions, provisions and results of vicious marriages that contain these responsibilities were included. These responsibilities, which represent an obligation for one of the parties and a right for the other, prevent many grievances. For this reason, the subject was examined in terms of spouses and children. During the study, it was determined that the Cumhur ulama, who did not accept the concept of fâsid theoretically, made use of this concept in practice and gave similar judgments. In addition to these, invalid marriage contracts in Civil Law were also mentioned and the points where today's law was affected by Islamic law were determined.
