Concept of ghurre in islamic law

People's rise to the world stage is made possible by the will of Allah and through his parents, not by his own free will. Allah did not give any human being a choice until he was born. Therefore, the whole process from conception to birth should be under the direction and control of the creator. Therewithal, no intervention that would hijack a person's right to live until the moment of birth was not allowed. However, many events have occurred throughout human history that resulted in the death of the fetus. Religious and legal systems prescribed various measures and penalties for murderous acts against the fetus and tried to prevent it. Our thesis, which consists of an introduction and five parts, ıt aims to examine the concept of ghurra, which includes the compensation awarded in response to an intervention against the fetus resulting in death in Islamic law. This concept has been compared with other legal systems and it is aimed to create a legal infrastructure in order to protect the rights of the fetus today. In line with this goal, abortion, gurre and related concepts are explained, the elements of ghurra, other legal consequences of intervention to the fetus, payment method and amount are emphasized. It is hoped that our study will fill an important scientific gap in terms of being the first Turkish thesis written about ghurre as far as we have been able to determine, and shed light on those who want to do research on this subject.
