Abstract (EN)
Within the scope of this study, a comparative analysis has been conducted between Islamic Inheritance Law and Turkish Inheritance Law — currently in force in the Republic of Türkiye — specifically with regard to parental succession and testamentary dispositions. The research examines various underlying legal, cultural, and systemic factors that contribute to the divergences between the two frameworks and evaluates their respective implications on the structure and application of inheritance rules. The purpose of this comparison is to analyze the inheritance institution, which constitutes a key legal mechanism in preserving the integrity of the family unit, by focusing on the aforementioned subject areas.
