Violence against women, which has existed throughout history, has become a very serious problem today. There is more than one type of violence against women. Although some of these types of violence have existed for many years, it took time for them to gain awareness and be included in the literature. In this context, stalking is not a type of behavior or crime that depends on the changing nature of social and personal relationships in recent years. On the contrary, although it has been named new terminologically and is a crime recently defined in the Turkish Penal Code No. 5237, it is a problem that has existed for a long time. It is clear that the crime of persistent stalking has serious consequences not only on individual but also on social interests. For this reason, while the arrangement is examined theoretically, it should also be evaluated in terms of functionality. In our study, the process of transformation into crime in other countries and Turkey is explained through a conceptual examination of the different terms used for stalking and stalking. Thus, the regulation in the Turkish Penal Code regarding persistent stalking, which turns into a crime, was evaluated in terms of the elements of the crime, and its qualified forms and aggravated forms due to its consequences were examined. In addition, the studies carried out by the state and the practices carried out by non-governmental organizations regarding the prevention and punishment of the crime of stalking were discussed, and the regulation of the crime of stalking was evaluated in the context of the principle of proportionality and the basic principles of crime policy
